Terms of Service

1. Acceptance of Terms

By accessing or using the Vesper WhatsApp API Gateway service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service. These Terms constitute a legally binding agreement between you ("User", "you") and Vesper ("we", "our", "us").

2. Description of Service

Vesper provides a REST API gateway for WhatsApp, enabling users to send and receive messages, manage WhatsApp sessions, configure webhooks, and manage groups through a programmatic interface. The Service is provided on a subscription basis with various plans.

3. Account Registration

• You must be at least 18 years old to create an account.
• You must provide accurate and complete registration information.
• You are responsible for maintaining the confidentiality of your account credentials and API keys.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.

4. Subscription and Billing

• New accounts receive a 7-day free trial with full feature access.
• After the trial period, a paid subscription is required to continue using the Service.
• Subscriptions are billed monthly in EUR. Prices are displayed on our pricing page.
• Payments are processed through iyzico. By subscribing, you also agree to iyzico's terms.
• You may cancel your subscription at any time. Access continues until the end of the current billing period.
• Refunds are not provided for partial months or unused service.
• We reserve the right to change pricing with 30 days notice.

5. Acceptable Use

You agree NOT to use the Service to:

• Send spam, unsolicited messages, or bulk promotional content
• Harass, threaten, or abuse other users or WhatsApp recipients
• Violate WhatsApp's Terms of Service or any applicable laws
• Distribute malware, phishing links, or fraudulent content
• Impersonate another person or entity
• Attempt to reverse-engineer, decompile, or exploit the Service
• Circumvent rate limits, usage quotas, or security measures
• Use the Service for any illegal activity

Violation of these rules may result in immediate account suspension or termination without refund.

6. API Usage and Rate Limits

• Each subscription plan has defined limits for apps, sessions, and messages per month.
• Exceeding your plan limits will result in API requests being rejected (HTTP 403).
• API rate limits are enforced per API key and per IP address.
• We reserve the right to throttle or suspend access if usage patterns indicate abuse.

7. API Keys and Security

• API keys are confidential. Do not share them publicly or embed them in client-side code.
• You are responsible for any API usage made with your keys, whether authorized or not.
• If you suspect a key has been compromised, revoke it immediately through the dashboard.
• We are not liable for damages resulting from compromised API keys.

8. WhatsApp Compliance

Vesper facilitates WhatsApp connectivity but is not affiliated with or endorsed by WhatsApp or Meta. You are solely responsible for complying with WhatsApp's Terms of Service and policies. We do not guarantee uninterrupted WhatsApp connectivity, as it depends on WhatsApp's infrastructure and policies.

9. Service Availability

We strive for high availability but do not guarantee 100% uptime. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify users of planned maintenance in advance.

10. Intellectual Property

The Service, including its design, code, documentation, and branding, is the intellectual property of Vesper. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms. You may not copy, modify, or redistribute any part of the Service.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VESPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. Our total liability shall not exceed the amount paid by you for the Service in the 12 months preceding the claim.

12. Termination

• You may terminate your account at any time by contacting support.
• We may suspend or terminate your account for violation of these Terms, non-payment, or at our discretion with reasonable notice.
• Upon termination, your access to the Service will be revoked and your data will be deleted in accordance with our Privacy Policy.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Turkey. Any disputes arising from these Terms shall be resolved in the courts of Istanbul, Turkey.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or through the Service. Continued use after changes constitutes acceptance of the revised Terms.
